An application for judicial review is a vital legal process that allows individuals and businesses to challenge the lawfulness of decisions made by public bodies — such as government agencies, local authorities and regulatory organisations — or for such organisations to defend their decisions. It isn’t about whether a decision was ‘right’ or ‘wrong’ — only whether it was made lawfully.
In judicial review proceedings, the courts will examine whether a public body has acted outside of its legal powers (ultra vires), made a decision that’s irrational or unreasonable, failed to follow fair procedures or violated human rights or statutory obligations.
If you believe that a decision has been made unfairly, unlawfully or beyond the powers of the decision-maker, a judicial review may provide you with a way to hold them accountable.
If you’re the decision-maker and facing a claim of judicial review, you’ll need to defend the claim to maintain your decision.
If you didn’t make the decision yourself but wish to participate in judicial review proceedings, you may be able to do so as an Interested Party or Intervener.

Judicial review proceedings
Our lawyers act in judicial review proceedings for a wide range of clients. We’re highly skilled at identifying opportunities for judicial review in existing proceedings, which — if successful — may bring an end to the matter in its entirety.
Judicial review proceedings have very strict time limits within which they must be started. A rigorous process must be followed thereafter. That’s why it’s so important to instruct lawyers who are confident and experienced in acting in these types of proceedings.
Public bodies — particularly regulators such as HMRC, the Serious Fraud Office and the National Crime Agency — are responsible for undertaking highly important societal functions, such as prosecuting serious criminal offences and collecting taxes. However, this doesn’t mean that public bodies are infallible. They can (and often do) make errors — and when this happens, there is a recognised process of judicial review that enables challenges to be made.
